Jakarta, CNBC Indonesia – The Ministry of Trade revealed that currently the progress of Indonesia's appeal against the European Union (EU) at the World Trade Organization (WTO) regarding Indonesia's raw nickel export ban policy is still hampered by the actions of the United States (US).
Special Staff to the Minister of Trade for International Trade Agreements, Bara Krishna Hasibuan, said that currently the US is still blocking Indonesia over its formation Appellate Body.
Formation Appellate Body or the Appeals Council at the WTO itself is actually to facilitate the submission of appeals from countries that wish to appeal a case decided by the WTO.
“Indeed, America has always blocked the formation Appellate Bodyappeals board, because they demand total reform at the WTO,” explained Bara to CNBC Indonesia in the Mining Zone program, quoted Wednesday (12/6/2024).
As a result, Appellant This body has not yet been formed because the formation of an appeals council requires the approval of all countries that are members of the WTO. Meanwhile, the US itself is the only WTO member that blocks its formation Appellate Body.
Therefore, the government itself cannot confirm when the appeals board will be formed soon.
“So for the formation of the appeals council, all WTO member countries must agree. So America is the only one who doesn't agree because it demands total reform,” he added.
Bara also revealed that even if the WTO appeals board is formed, the appeal of the Indonesian nickel export ban case will still have to wait in line for the case to be discussed by Appellate Body.
“Well that's who we are cases number 21. So it cannot be done immediately if the WTO is formed, the nickel case between us and the EU will be discussed immediately. “We have to queue, we are queued at 21. So it will also take time, until our case is actually heard,” he stressed.
Previously, the Coordinating Minister for Maritime Affairs and Investment (Menko Marves), Luhut Binsar Pandjaitan emphasized that currently the European Union is willing to negotiate with Indonesia. This was after the European Union sued Indonesia at the World Trade Organization (WTO) over the ban on Indonesian nickel exports.
As is known, last year, Indonesia lost a lawsuit at the WTO by the European Union. Currently, Indonesia is appealing the defeat of the lawsuit.
Coordinating Minister for Marves Luhut emphasized that currently the European Union wants to negotiate with Indonesia so that Indonesia does not carry out further exports of nickel products such as stainless steel.
“The European Union wants to negotiate with us. At the WTO they said that exports should not be banned from tiers 2-3,” said Luhut at HIPMI's 52nd anniversary and the declaration of National Entrepreneurship Day, Monday (10/6/2024).
Luhut firmly said that currently, Indonesia has a large electric vehicle (EV) battery ecosystem. In fact, it is predicted that Indonesia will become the most advanced country in this regard.
