Jakarta, CNBC Indonesia – Apple is trying to continue selling the Apple Watch even though it has been blocked by a United States (US) court. The way to do this is by changing the product design.
Apple has been dragged into a patent problem for the pulse oximetry technology used in its smart watch products. The matter was brought to court by Masimo, who previously discussed cooperation with the Cupertino company.
According to Masimo, Apple has stolen the trade secrets of his company's technology for reading blood oxygen levels. Not wanting to be outdone, Apple also sued again for patent infringement and taking over Masimo's actions as a maneuver to open the way for competitors.
Masimo asked the ITC to prohibit Apple from selling Apple Watches that allegedly infringe its patents. The ban has been in effect since December and the Series 9 and Ultra 9 were discontinued in the US before Christmas.
But not long after, on December 27 2023, the problematic Apple Watch was back on sale. This comes after Apple convinced the Court of Appeal to stop the ban.
Apple said the redesign would avoid patent infringement being pointed at the company. However, the iPhone maker did not show the new appearance of its product, quoted from Reuters, Tuesday (16/1/2024).
Apple told US Customs and Border Protection that its new watch will not contain a pulse oximetry function. Meanwhile, Masimo welcomed the idea as a positive step.
“Apple's claim that the redesigned watch does not contain pulse oximetry is a positive step towards accountability,” said spokesman Masimo.
